1. Controller Identification
This website is jointly controlled by Eco-Business Fund S.A., SICAV-SIF, 31 Z.A., Bourmicht, L-8070 Bertrange, Luxembourg, and Finance in Motion Asset Management S.à r.l., 68, Boulevard de la Pétrusse, L-2320 Luxembourg, Grand Duchy of Luxembourg (“FiM”). FiM acts as the Fund’s representative with regard to all functions. The Fund and FiM together are also referred to as “we”.

2. Personal information you choose to provide
We may process the personal information you choose to provide through any of the contact facilities of this website. The information you provide to us will be used for the purpose of answering your queries or for operational and administrative purposes. We limit this processing to the extent required to perform the Fund’s contractual obligations vis-à-vis you or to prepare such a contract at your request. This information will not be transferred to third parties without your permission, except as required under a legal obligation such as to comply with finance regulations. We retain such data for the duration of your contractual relationship with the Fund plus the retention times required to meet our regulatory requirements and substantiate or defend against potential claims.

3. Cookies, Web Audience Measurement
This website uses cookies. A cookie is a small text file that is copied to your browser by a web server. As a rule, cookies we set are only used for the length of your session for the purpose of anonymous, statistical assessments and for improving user-friendliness. You can review and delete or disable cookies at any time via the settings in your browser or may opt-out of our web audience measurement described below.
For web audience measurements, we use Matomo (http://www.matomo.org), a cookie based open source web analysis service that we operate on our web server. Matomo helps us understand how visitors use our website. Matomo truncates your IP address so that we cannot identify you. We use the information generated by Matomo solely to evaluate how our audience uses the website, i.e. to compile anonymously aggregated reports on website activities. We do not pass any personal data to third parties.
The legal basis for this processing is our legitimate interest in measuring our reach and improving our website. You may object to Matomo based web audience measurement by clicking on the link below. If you don't see the corresponding text, you have already objected to using Matomo – likely on another website, in which case we honor this opt-out also. 5. Data security
We do not process business critical or sensitive information using this website; it contains public information only.
We take appropriate technical and organizational measures to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed. The Internet operates as a decentralized association of networks with respect to the interim storage and transfer of temporary data. For this reason, it is not possible at the present time to provide a guarantee against possible manipulation or inadvertent corruption of data, or to guarantee that only current data will be used (e.g. because an old version is still in cache) en route from the provider to the user and vice versa. We therefore advise you of this system-related restriction as follows: you receive this information subject to the conditions of the Internet. Accordingly, no guaranty can be provided as to the correctness of the information and its conformity with the original data.

6. Your Rights
You may, in accordance with applicable data protection law,
request information about the data processed about you, obtain a copy of such data, and have inaccurate data rectified or completed;
have your personal data erased or its processing restricted, each to the extent one of the grounds provided for by statutory law applies;
receive the personal data you provided to us under contract or consent in a structured, commonly used and machine-readable format, to the extent the statutory requirements are fulfilled;
object, for reasons relating to your particular situation and in accordance with applicable law, to any of our legitimate interest based processing of your personal data; and
withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
We do not to use any automated individual decision making processes.

You also have the right to lodge a complaint with a competent data protection authority, in particular in the country of your habitual residence.

The eco.business Fund provides a formal complaint mechanism to allow investors, clients, project affected people (e.g. individuals, communities, workers) and other third parties the opportunity to complain or raise concerns. Filling a complaint supports the Fund to identify, investigate and take appropriate steps to help resolve problems, reduce risks and remedy impacts.

Treatment of your complaint
Within 10 business days, the complainant receives a confirmation that the complaint has been received. Each complaint will be investigated through a fair and independent view on the complaint, facilitating a response to the complainant no later than one month from the receipt of the complaint. In some cases, the investigation of the complaints may take longer than one month, in which case the Contact Person will inform the complainant of such in the due response, and keep the complainant informed about the investigation’s status thereafter until resolution.
If the complainant does not receive an answer or receives an unsatisfactory answer, the complainant is entitled to address the Fund’s Complaint Officer via the same channels provided above. If within a delay of one month from the day on which the complaint was addressed to the Complaints Officer, the Complainant does not receive an answer or receives an unsatisfactory answer, the Complainant may address the request to the Board.
 

Where the complainant is an investor or client, if no adequate response has been received within a further two weeks, the complainant may also escalate the matter to the CSSF in accordance with the Luxembourg law of 17 February 2016 introducing alternative dispute resolution for consumer disputes into the Consumer Code and amending certain other provisions of the Consumer Code. By default, your complaint will be treated confidentially, and your identity kept anonymous. Only parties concerned by the complaint’s investigation will be made aware of the complaint and your identity will not be disclosed to them without your prior consent. Should you wish otherwise, please state clearly that you agree to your identity being disclosed.

The fund, sub-fund(s) and securities described herein are not being offered for sale to the public in the United States of America or in any other jurisdiction in which a public offer would be prohibited by applicable law. The fund, sub-fund(s) and securities described herein are being offered in these jurisdictions only by private placement to a limited number of qualified institutional investors in accordance with the applicable laws and regulations in these jurisdictions. Offers will only be made pursuant to a private placement memorandum approved by the fund.
